General terms and conditions of sale

The present website julyette.com is operated under license by the company JULYETTE ONLINE with a share capital of €1000.00, registered with the Trade and Companies Register of Bordeaux under number 990 030 215 RCS Bordeaux, whose registered office is located at 356 Avenue de l'Argonne, 33700 Mérignac (France).

2. General provisions relating to these general terms and conditions of sale (hereinafter referred to as the GTC)

The General Terms and Conditions apply exclusively to the online sale of products marketed by JULYETTE ONLINE from the website julyette.com, (hereinafter the website) which is openly accessible.

The General Terms and Conditions of Sale govern exclusively the online sales contracts of JULYETTE ONLINE products (hereinafter referred to as the professional seller) to buyers who are final consumers (hereinafter referred to as the consumer) and together with the online order constitute the contractual documents enforceable between the parties, to the exclusion of all other documents, brochures, catalogues or photographs of the products which have only an indicative value.

The Customer who purchases on the Site declares that they are legally capable of entering into these general terms and conditions of sale.

All internet users must be at least 18 years old and have the legal capacity or parental authorization to place an order on the website. In accordance with the commercial policy described above, JULYETTE ONLINE reserves the right to refuse orders from any person who is not a "final consumer" or orders that do not comply with its commercial policy as defined herein.

The General Terms and Conditions apply exclusively to products delivered to consumers established in France and/or in a member country of the European Union.

The validation of the order by its confirmation constitutes acceptance by the buyer of the CGV in force on the day of the order, the preservation and reproduction of which are ensured by the professional seller in accordance with article 1127-2 of the civil code (former C. civ., art. 1369-4).

2.5 General Terms and Conditions Clauses

The invalidity of a contractual clause does not render the General Terms and Conditions invalid. The temporary or permanent non-application of one or more clauses of the General Terms and Conditions by the professional seller cannot constitute a waiver by the seller of the other clauses of the General Terms and Conditions, which remain in full force and effect.

3. Products

JULYETTE ONLINE strives to present and describe its items as accurately and precisely as possible. The site offers fashion items for sale.

The products offered for sale and presented in the catalog published on the website are each accompanied by a description outlining their essential characteristics as defined in Article L. 111-1 of the French Consumer Code. The photographs illustrating the products are not contractual documents.

JULYETTE ONLINE cannot be held responsible for damages caused by misuse of products sold on its site or by failure to comply with precautions for use.

3.1 Compliance

The products comply with all applicable regulations concerning the safety and health of persons, fair business practices, and consumer protection at the time they are placed on the market. The products also comply with all applicable French law in force at the time they are placed on the market.

3.2 Stocks

Products are offered and delivered subject to availability.

In the event that the ordered product is unavailable, the seller shall immediately inform the buyer and may offer a product of equivalent quality and price or, failing that, a voucher for the amount of the order usable for any future order.

In the event of disagreement by the buyer, the seller will proceed with the refund of the sums paid within 10 working days.

Apart from refunding the price of the unavailable product, the seller is not liable for any cancellation compensation due to stock shortage.

3.3 Resale of products

Products sold on the site may not be resold or packaged without the prior written consent of JULYETTE ONLINE.

4. Price

4.1 Selling price

In accordance with Article L. 112-1 of the Consumer Code, the selling prices are indicated, for each of the products listed in the electronic catalogue, in euros inclusive of all taxes, excluding delivery and transport costs mentioned before validation of the order and charged in addition.

The total amount due by the consumer is shown on the order confirmation page.

The selling price of the product is the one in effect on the day the order is placed.

The selling price of the products does not include shipping costs, which are charged in addition to the price.

In the event of a price promotion, the professional seller undertakes to apply the promotional price to any order placed during the period of the advertising campaign.

4.2 Modification

The professional seller reserves the right to modify its prices at any time, while guaranteeing the consumer the application of the price in effect on the day of the order.

4.3 Fees

Additional transport, delivery or postage costs (plus any other costs incurred by the seller), which the customer was able to review before ordering, are specified on the order form.

5. Offer

5.1 Domain

The online sales offers presented on the site are reserved for consumers residing in France and/or in a member country of the European Union and for deliveries in these same areas.

5.2 Duration

The online sales offers presented on the site are valid, unless otherwise specified, as long as the products are listed in the electronic catalogue and within the limits of available stock.

5.3 Acceptance

The consumer's acceptance of the offer is validated, in accordance with the double-click procedure, by the confirmation of the order.

6. Order

6.1 Contract Conclusion Steps

To place an order, the consumer, after filling their virtual basket by indicating the selected products and the desired quantities, then clicks on the "Order" button and provides the information relating to delivery and payment method.

Before clicking the "Confirm order" button, the consumer has the opportunity to check the details of their order and its total price and to return to previous pages to correct any errors or possibly modify their order.

By submitting the order form electronically, you unconditionally accept and agree to comply with these General Terms and Conditions of Sale in your dealings with JULYETTE ONLINE. If you disagree with any of the terms stated in these General Terms and Conditions of Sale, please do not submit your order form for the purchase of products on the website "www.julyette.com".

By submitting your order form, you confirm that you have read and agree to these General Terms and Conditions of Sale without reservation.

An email acknowledging receipt of the order and payment is sent by the seller as soon as possible.

6.2 Order Modification

Any order modification by the consumer after order confirmation is subject to acceptance by the professional seller. The professional seller reserves the right to make modifications to the ordered product related to technical developments, under the conditions stipulated in Article R. 212-4 of the French Consumer Code.

6.3 Order Validation

The professional seller reserves the right to refuse any order for legitimate reasons, particularly if the quantities of products ordered are abnormally high for buyers acting as consumers. The seller may also refuse or delay the processing of an order if they suspect any form of fraud, such as identity theft or theft of payment methods.

7. Contract

8. Payment

The price is due in full upon order confirmation. Payment is made immediately upon ordering by credit card. The products remain the property of JULYETTE ONLINE until full payment is received by JULYETTE ONLINE.

8.2 Payment Security

The site uses a secure online payment system that allows consumers to encrypt the transmission of their bank details via the secure payment platform's server. At no time will the consumer's bank details pass through JULYETTE ONLINE's computer system.

9. Delivery

9.1 Definition

Delivery is understood to mean the transfer to the consumer of physical possession of the goods.

9.2 Shipping Time

Under normal circumstances, the professional seller will process the order as quickly as possible, Monday through Friday, excluding public holidays. JULYETTE ONLINE commits to shipping orders within 3 to 5 business days following order confirmation, subject to stock availability.

9.3 Delivery time

The prepared order will be handed over to JULYETTE ONLINE's service providers: DHL

For delivery in Europe, the delivery time excluding preparation is 3 to 5 days following the order.
The following countries are not served: United Kingdom (England, Scotland, Wales), Switzerland, Norway, Iceland, Liechtenstein, Andorra, Monaco, Albania, Bosnia and Herzegovina, Kosovo, North Macedonia, Montenegro, Serbia, Ukraine, Moldova, Belarus, Russia, Turkey.

JULYETTE ONLINE cannot be held responsible for any delays or losses.

To facilitate delivery of the order by the carrier, the customer agrees to make the necessary efforts to allow delivery of the package: name visible on the mailbox, transmission of the access code, telephone number, follow-up of emails sent, answering telephone calls from the carrier.

9.4 Delivery Delay

In the event of a delivery delay of more than 7 working days, the customer must inform JULYETTE ONLINE customer service, which will implement the necessary and appropriate actions.

9.5 Delivery Location

Products are delivered to the address provided by the customer on the order form. JULYETTE ONLINE delivers to all EU countries except those listed above in article 9.3.

9.6 Product Conformity

If the product does not conform to the order, the consumer must address a complaint to the professional seller in order to obtain a replacement of the product or possibly a cancellation of the sale.

9.7 Transfer of Ownership

From the delivery date indicated in the order form, ownership of the product is transferred to the buyer, except in the case where full payment of the price has not been received at the time of ordering.

10. Product returns and right of withdrawal

JULYETTE ONLINE is committed to providing you with high-quality products. However, if you are not satisfied with your purchase, JULYETTE ONLINE will exchange or refund it. Return shipping costs will be your responsibility.

You have 14 days from the date of receipt (postmark date) to return the products in their original condition (undamaged packaging, in resalable condition), along with the invoice issued by JULYETTE ONLINE and any gifts or samples. A refund or credit note for the initial amount of your order, excluding shipping costs, will be issued upon receipt of your package, provided it meets the return conditions. JULYETTE ONLINE may postpone the refund until the products have been received and verified.

Damaged, opened, or incomplete items will not be accepted and will be returned to you as is, at your expense. JULYETTE ONLINE will also not accept packages sent with postage due.

JULYETTE ONLINE reserves the right to refuse a return if it exceeds the legal withdrawal period.

11. Processing of personal data

JULYETTE ONLINE processes consumer information in accordance with its Privacy Policy.

12. Dispute Resolution

JULYETTE ONLINE cannot be held responsible for damages resulting from improper use of its products.

In the event of a dispute, you should first contact the company's customer service department by email (lydie@julyette.com) in order to try to resolve the dispute amicably.

13. Responsibility

The products offered comply with current French legislation. It is your responsibility to check with the local authorities in your country regarding the import or use of the products or services you intend to order. The website "www.julyette.com" cannot be held responsible for the non-performance of the contract in the event of stock shortage, product unavailability, force majeure, disruption, flooding, fire, or strikes, particularly affecting postal services, transportation, or communication. The website "www.julyette.com" will not be liable for any direct or indirect damages resulting from these risks.

14. Applicable Law

This contract and the general terms and conditions governing it are subject to French law.

Generally speaking, the trademarks and logos appearing on this site, whether registered or not, are the exclusive property of their owner, who grants a license to JULYETTE ONLINE.
